Our views on victims' rights differ vehemently from those of insurance lobby groups that preach "tort reform". The "tort-reformers" and journalists are not interested in lives of people destroyed by substandard medical care. They are not interested in why it happened, and how to prevent such devastation from happening again; nor the devastating effects on an innocent person's life; or why no one is held accountable; or even the possibility of this happening to them or a loved one.

Instead "tort-reformers" and the journalists turn their outrage on those who question why the government is attempting to shield bad doctors and drug companies who harm people through their negligence.

Politicians should be the voice of the people. Government should be trying to keep you safe. Instead they are fueling this shameful march to take away your rights, one by one. If corporations do not have the threat of a lawsuit, i.e. the threat of being held accountable when their goods or services harm someone, why would they spend any time or money on ensuring the safety of the public? Why is this question never discussed? Why are we not interested in keeping ourselves safe?

  • Drug companies must be made accountable for drugs that injure. Vioxx was knowingly unleashed on an unsuspecting public for billions of dollars in profits; where is the outrage.
  • Outrage should be directed at the substandard medical care being received in this country, for enormous profit, instead of labeling the injured victims of malpractice as "frivolous". Why is no one concerned with trying to stop malpractice?
  • The insurance industry can limit the cost of awards by working to limit the number of victims (in any service or industry).
  • The Government should limit the cost of awards by working to limit the number of victims (in any service or industry), by enforcing and not relaxing regulations.

Why is the Government prepared to willingly increase the dangers to you and your family, of those who value profit over people? Is it because they are too concerned with reelection? And with the corporate contributions needed to secure reelection?

We are losing our rights to keep ourselves safe, and no one is asking why. The only recourse ordinary citizens have to keep them safe from the actions of those who value profit over human life is the right to sue.

What is most troubling to us, not as lawyers, but as human beings, is the fact that there is absolutely no concern for the victims of malpractice. Hundreds of thousands of people, maimed and injured, many times by doctors who have maimed others in the past. Injuries which could have been avoided. Instead the Government is limiting your rights to hold those who commit medical negligence accountable.

There is no concern for protecting workers on dangerous construction sites, instead the government is easing regulations designed to ensure safety.
